Rental Agreement Introduction:
If your possessions such as house, lands, flats, rooms etc are allowed to use by someone for certain period of time by charging with certain amount of money, then it is understood as ‘Renting’. The person who gives his/her possession in rent is ‘Landlord’ and the one who use the property and give rent is ‘Tenant’. Both landlord and tenant may a person or an organization. While renting, an aggrement is done between Landlord and Tenant which is called Rental aggrement. So, we will discuss here the points and things to be considered in Rental aggrement. Rental Agreement in Nepal should consider the following points:
Based on the National Civil (Code) Act, 2074 Section 386:
- Full name, address, Nepali Citizenship number, NID (National Identity Number), mobile number of both landlord and tenant. If tenant is other than Nepali citizen, then his/her passport details, passport number, Identitiy verifying certificate,
- Address of Property to be rented, Kitta Number of land, total area of building or land to be rented, details of flats or rooms,
- Purpose of Rent,
- Start Date for Rent
- Tenant period and provisions of extension of tenant period if present,
- Monthly or Annual Rent amount. Provision of increment in Rent,
- Rent payment mode and time,
- Obligation to pay fees for electricity, water, telephone, garbage management, etc. used in the property to be rented,
- Provisions related to payment of बहाल कर,
- Matters related to insurance of property if insurance need to be done,
- Matters related to vacating the property under rentif necessary,
- Whether or not the property taken under rent can be given over rent to another person,
- Provisions relating to maintenance and repair of rented property,
- Provisions related to amendment of agreement,
- Whether or not a structure can be constructed, partially constructed or modified,
- Provision regarding compensation in case of use of property contrary to the agreement,
- Conditions under which the contract may be terminated,
- Other essential matters.
When preparing a rental agreement, the photo of the tenant should also be pasted. Three copies of the agreement should be prepared, two copies each for Landlord and Tenant and one copy. There should be at least two witness from both parties in the Rental agreement.
